Diego Lepervanche shall join Luis Bárcenas of Ecoanalítica in the analysis of the Organic Law of Special Economic Zones (LOZEE), to be held on August 30, from 8:00 to 11:00 a.m., at the JW Marriot Hotel in Caracas. As provided in Decree N° 4,420, published in Official Gazette N° 42,049 of January 18, 2021, individuals residing in Venezuela must pay income tax only on amounts which exceed 5,000 tax units. The limit applies to taxable net enrichments from territorial source obtained during the 2020 fiscal year. Taxpayers, who have already declared and paid 2020 income tax without taking such baseline into account, will receive a tax credit to be applied to subsequent fiscal years.
The decree was published in the Official Gazette dated December 31, 2020. It extends the protection granted to workers regarding dismissal, for a two year period, and applies to all workers, both in the public and private sectors. Workers protected by this decree cannot be fired, or have their situation changed for the worse, or be transferred, unless the Labor Inspector previously qualifies such actions as due to a "fair cause". Workers in management position, and seasonal or occasional workers are excluded from this protection.

The procedure establishes that the relevant documents should be sent in PDF format to the Secretary of the Chamber by e-mail. The sender must explain his/her accreditation, and commit to deliver the original document to the Secretary of the Chamber, at the first opportunity. Once the electronic formalization has been made, the Chamber shall notify the other party by electronic, telephone or digital means, so that the latter, by the same electronic means, may challenge or answer the claim. The Secretary of the Chamber shall reflect these actions expressly in the file.

The article “Covid-19: Force Majeure and Hardship Clauses in Contracts”, by our partner, Carlos Eduardo Acedo Sucre, is part of the work “Legal Studies on the COVID-19 Pandemic and the Decree of the State of Alarm in Venezuela”, published by the Academy of Political and Social Sciences jointly with the Editorial Jurídica Venezolana Internacional. Once again, Resolution N° 001-2020 of the Supreme Court of Justice has been extended. This Resolution provided that no Court would dispatch from March 16 to April 13, 2020, except in the cases established therein. This suspension has been extended every month since then. In this new period, the cases will remain in suspension and the procedural lapses will not run. However, urgent actions may be practiced to ensure the rights of any of the parties, in accordance with the law. With regard to constitutional protection, the days of said period will be considered enabled. In criminal matters, the service will continue only for urgent matters. The courts are ordered to make provisions to guarantee access to justice, in accordance with the objectives of the Resolution, including in certain cases the establishment of shifts.
This week, from Tuesday 16th to Thursday 18th, registries and notary offices are open for service, from 8 a.m. to 12 p.m., as confirmed by the regulating agency, SAREN on its website. As part of the general quarantine flexibilization schedule (7 + 7), which establishes that next week said entities will be closed. For its part, the Full Chamber of the TSJ, in Resolution No. 004-2020 of June 12, 2020, extended the suspension of courts’ activities for 30 additional days, except for constitutional protection and the processing of urgent matters, until July 12, 2020. A new Decree declaring the State of Alarm for thirty days was published in the Official Gazette, following the end of the extension of Decree N° 4.160 of March 13, 2020. The Decree is based on the persistence of the exceptional and extraordinary circumstances which motivated the March Decree, related to the COVID-19 pandemic, which has reached "over four million people over the world", and is very similar to such previous Decree. Article 1 decrees the State of Alarm, given the social order circumstances that put at grave risk the citizens’ public health and security, and indicates that the National Executive shall adopt “urgent, effective and necessary measures of protection and preservation of the health of the Venezuelan population, in order to mitigate and eradicate” the COVID-19 pandemic.
